Judge denies motion on Rafael Santos


A Winnebago County Judge sticks with his original sentence for a man accused of murder.

Rafael Santos was convicted of killing Isidro Duran.  The ice cream vendor was shot several times on Loomis Street in Rockford back in July of 2007.  Duran was selling ice cream from his cart at the time.  Santos and two other men, Michael Jennings and Justin Dismuke tried to rob him. Duran was shot several times in the back as he tried to run away from his attackers.   Santos was the one who had the gun and pulled the trigger. He was sentenced to 70 years in prison.  Jennings and Dismuke are serving smaller sentences for their roles in the crime.

Santos asked Judge Gary Pumilia to reduce his sentence, the motion was heard and denied.  His lawyers filed an appeal to Santos' conviction.
