Judge rules against putting Ted Biondo's name on the November ballot.ROCKFORD - Winnebago County Board Member Ted Biondo has lost his effort to get put on the November ballot.
Tuesday a judge denied Biondo's request to be put on the ballot for the county board seat he is currently holding. Biondo was assigned to the seat after Republican Mary Ann Aiello died in June. Biondo says he was told he would serve out the remainder of Aiello's term and didn't need to run for the seat. That's why he didn't file any paperwork to run.
Democrat Carolyn Gardner did file paperwork to run and then won a lawsuit to get her name on the ballot, arguing that anyone should be able to run for the position because of how much time was left on Aiello's term.
The Winnebago County State's Attorney's office or Biondo could appeal the decision.
The chair of the Democratic party says he's pleased with the ruling.
