WINNEBAGO COUNTY - A Loves Park democrat files a lawsuit against local election offices because they won't put her name on the ballot.

The issue is over Mary Ann Aiello's District 9 seat on the Winnebago County Board. She passed away in June and the board appointed another republican, Ted Biondo, in her place.

But democrat Carolyn Gardner says there was more than 28 months left on Aiello's term and because of that the seat is open to any party for the November election.

She filed papers to run for the seat, but says the county clerk and Rockford Board of Elections won't put her on the ballot.
